He petitioned the Commission for reinstatement.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><b><u><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">FACTS OF THE COMPLAINT<o:p></o:p></span></u></b></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: .75pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">The Complainant, a former accountant of the Respondent's institution stated that in a letter dated 315' March 2011, the Respondent terminated his appointment for vacating his post. According to him the termination of his appointment was an attempt by the Respondent to cover up a serious financial fraud within the institution which he tried to correct. He claimed that the termination letter raised some accusations such as disrespect to authority, vacation of post, refusal to release money for staff party and refusal to sign appraisal form. The Complainant denied these accusations and petitioned the Commission to investigate the unlawful termination of his appointment for justice and peace to prevail.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><b><u><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">THE COMMISSION'S MANDATE<o:p></o:p></span></u></b></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;text-indent: 2.4pt;mso-pagination:none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">In accepting to undertake investigation into the above complaint the Commission was guided by Article 23 of the 1992 constitution on administrative justice. It states that...<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0in;margin-right:0in;margin-bottom:5.0pt; margin-left:.5in;text-align:justify;text-indent:.2pt;mso-pagination:none; border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow:yes"><i><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">"Administrative bodies and administrative officials shall act fairly and reasonably and comply with the requirements imposed on them by law and persons aggrieved by the exercise of such acts and decisions shall have the right to seek redress before a court or other tribunal”.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">It is against this background the Commission accepted to investigate this complaint.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><b><u><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">RESPONDENT COMMENT<o:p></o:p></span></u></b></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">In its comment on the complaint, the Respondent stated that, its head office in Accra received numerous complaints and copies of queries, warnings of absenteeism and misconduct about the Complainant from its Regional Office in Ho. According to the Respondent, the Complainant's personal record file contains numerous reports of insubordination from all the stations he was posted to. The Respondent claimed that, the Complainant's termination was done in accordance with Article 18(viii) and (vii), as well as Article 19(vi) of the Ghana Museum and Monument Board's Condition of Service.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><b><u><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">INVESTIGATIONS AND FINDINGS<o:p></o:p></span></u></b></p><p class="MsoNormal" style="margin-bottom:5.0pt;text-align:justify;mso-pagination: none;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt;mso-border-shadow: yes"><span style="font-size: 12pt; line-height: 115%; font-family: "Book Antiqua", serif;">Upon receipt of the Respondent comments, the Commission invited the Complainant for comments on the Respondent's comments. During the meeting, the Complainant informed the Commission that he petitioned National Labour Commission which had commenced hearing into the complaint. The Commission, as a result, advised that in so far as the National Labour Commission had commenced hearing into the complaint, it could not continue its investigation because the matter was being handled by another competent forum. Consequently, the Complainant informed the Commission that the National Labour Commission had directed the Respondent to reinstate him with effect from April, 2011.
