</div>Reference your letter above, Management of Foto-X Ltd. wishes to
respond as follows:<o:p></o:p>Each staff has a personal contract, Foto-X Limited
has no Collective Bargaining Agreement with staff, and each staff is therefore
treated as an individual.<o:p></o:p>No employee has an end-of-service package written into their
contract. Each staff was given a minimum of a month's notice. There was no
unresolved dispute with employees of Foto-X Ltd.<o:p></o:p>Over the last few years, the company has had
challenges with its client which has made our cash-flow situation untenable.
Management therefore took the tough decision to terminate the appointment of
some staff in order to reduce our financial commitments while attempting to
resolve the challenge.<o:p></o:p>Please find attached a copy of the contract of employment for Mrs.

the Complainant and the Respondent's response to the complaint that the reasons
for the termination are not disciplinary in nature. The Respondent is also not
exercising their right under any clause or provision of the conditions of
service which was submitted to this Commission for the terminations.<o:p></o:p><o:p>&nbsp;</o:p>Xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx<o:p></o:p>Quit clearly the Respondent is restructuring their operations to
meet their neu financial situation and in remain in business. It is this
restructuring which has occasioned the termination of the employment of the
Complainants. What then is the legal effect of the termination and the reasons
that brought about same?<o:p></o:p>It is provided under Section 05 (1) of the Labour Act 2003 (Act
651) as follows:<o:p></o:p>
