By a letter dated 26th February 2016. The Commission served the said complaint on the Respondent to react to in line with Regulations 710 of the National Labour Commission Regulation 2006[LI.1822]. By a letter dated March 8th 2016, the Respondent acting by its Executive Director Responded to the complaint filed by the Complainant.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:normal;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span lang="EN-US" style="font-size: 12pt; font-family: "Book Antiqua", serif;"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:normal;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span lang="EN-US" style="font-size: 12pt; font-family: "Book Antiqua", serif;">The Commission heard the parties on 18th May, 2016 and 15th June 2016. At the hearing of 15th June 2016 the Commission decided to deal with the matter summarily and thus directed the parties to state their respective cases in the form of affidavits with exhibits together with written addresses to the Commission. The Commission on 6 September 2016 ruled on that matter and ordered the parties to go back and negotiate.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:normal;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span lang="EN-US" style="font-size: 12pt; font-family: "Book Antiqua", serif;"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:normal;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span lang="EN-US" style="font-size: 12pt; font-family: "Book Antiqua", serif;">The parties again reported their inability to negotiate whereupon this Commission referred the matter to mediation by a letter dated 3rd October, 2016. Whereas the Complainant responded in the affirmative, the Respondents refused to respond thereby disenabling the mediation process from resolving the matter.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:normal;border:none;mso-padding-alt:31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow:yes"><span lang="EN-US" style="font-size: 12pt; font-family: "Book Antiqua", serif;">The Commission therefore decided to determine the matter by itself. We have also heard the arguments put up by the parties. Both parties are in agreement that there is the need for a salary increment. The increment is to take effect from the date of expiry of the old Collective Agreement. The 15% ordered by this Commission shall operate a minimum and not a maximum.
