I have read the application and the supporting affidavit. I have also read the affidavit in opposition. Regard has been given to the statement of case filed by both Counsel. I have also given my thoughtful consideration of Order 25 of C.I. 47 and the principles governing the grant or refusal of applications of this nature.<o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><b><span lang="EN-GB" style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif""> </span></b><span lang="EN-GB" style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif"">I must say that I find the application quite strange. The fact is that the Plaintiff is in Court to challenge his dismissal by the Defendant on the grounds that the dismissal was unlawful and is seeking an order for compensation.<o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> If the fact of the dismissal does not exist, I do not think the Plaintiff would have brought the present suit. Furthermore, Court proceedings are held in public, unless otherwise directed to be held in chambers. Being a process held in a place the general public are entitled to be present if they desire, what useful purpose would an injunction have. Anyone who happens to be in Court when proceedings in the matter is held will know that the matter is about the dismissal of the Plaintiff by the Defendant. It should be observed that a Court of law does not make vain orders. If the purpose of an order cannot be achieved, I do not think such an order should be made in the first place.<o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> Furthermore, restraining the Defendant from disclosing the fact that the Plaintiff has been dismissed may hinder on the right of the Defendant to disclose to other financial entities or statutory bodies relevant information they may require about the Plaintiff. If the application is granted, to me, it shall constitute gaging the Defendant.<o:p></o:p></span></p><p> </p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif""> The dismissal being a factual matter which in my view is the status quo between the parties, until the dismissal is set aside as being unlawful, the Defendant cannot be restrained from saying the truth. For these reasons, I refuse the application for Interlocutory Injunction. Same is dismissed. I make no order as to costs.<o:p></o:p></span></p></span>
