It is the plaintiff’s case that it is a customer of the defendant at its Abbosey Okai Branch in Accra. According to the plaintiff it has been the practice of the defendant to notify its customers regarding transactions on their accounts via SMS Text alerts.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">Sometime January 2016 the plaintiff says it noticed that it had not received alerts in respect of deposits of various amounts made on its behalf by its employee one Clement Quansah at the defendants Adum, Kumasi Branch, since 31<sup>st</sup> August 2015. Plaintiff says investigations revealed that indeed Clement Quansah did make deposits as evidenced by copies of stamped pay-in slips plaintiff had in its possession, however the plaintiff says further investigation revealed that the defendants Tellers did not crosscheck the name of the plaintiff against the account number into which the funds entrusted to Clement Quansah, were credited to.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">It is the plaintiff’s case that the defendant through its tellers owed the plaintiff a duty of care to ensure that whatever was received in its name ended up in its account.
