The ruling arose from a contempt application brought by the applicants after an interim injunction had been granted on 7 May 2019 in Suit No. P/OCC/06/19 concerning the management and operation of Watch and Dine Ltd. The applicants alleged that despite the injunction restraining certain defendants and persons acting on their instructions from continuing the running, operation and administration of the company, the respondents continued business operations, disregarded the order, and circulated statements suggesting no injunction had been granted. The respondents denied contempt, contending among other things that some of them had not been personally served with the order, that the order did not restrain some of the cited persons, that those served had ceased involvement, and that no penal notice had been served. This ruling is in respect of a contempt application filed on behalf of the Applicants herein against the Respondants herein. The Applicants are praying this Honourable Court for an order committing the Respondents for contempt of courtfor bringing the administration of justice into disrepute by their deliberate conduct in disregarding an order of interim injunction imposed by the Court on the 7th of May, 2019.
