ALBERT OWUSU BAAH vs. MRS. AGNES OWUSU ASARE, ALEX OWUSU ASARE & 2 ORS

The dispute concerned House No. 63 Mbrom, Kumasi, the self-acquired property of the late Baffour Owusu Amankwatia IV (also known as Anthony Asare Owusu/A.A. Owusu), who devised it by will in 1978 to his family. In 1979, the AFRC government confiscated the property. The testator died in 1985 while the property remained confiscated. Probate of his will was granted in 1991. In April 1992, the PNDC government deconfiscated/released the property. The contest was whether, upon release, the property devolved according to the will on the deceased’s maternal family represented by the appellant, or whether it was released to the deceased’s wife and children, the respondents, who later obtained letters of administration and registered title in their names. The judgment’s factual basis appears principally at paras. 1–12 and 53–55 of the Supreme Court judgment.
