AWUDU ALHASSAN SULEMANA @ DOZER, MOHAMMED SULEMANA @ BANANA & SALAMATU KARIM @ MOTHER vs. THE REPUBLIC
The deceased, Abdul Karim, was killed at his residence at ACP Estates, Pokuase, on 15 June 2013 after a violent assault. The 3rd appellant, who was his wife, initially reported to the police that unknown robbers had attacked the house and murdered him while she was bathing. Police investigations later shifted after PW1, Kofi Nyagbedzi, disclosed information implicating the 1st and 2nd appellants. The prosecution’s case was that the 3rd appellant planned the killing of her husband, recruited the 1st and 2nd appellants, admitted them into the house, concealed them in the bathroom, identified the deceased, supplied weapons, and promised payment. The 1st and 2nd appellants were said to have made confession statements admitting participation and implicating the 3rd appellant. All appellants denied the allegations and claimed the confessions were procured by force and inducement. Portion of judgment: under the heading “Facts”, beginning with “The facts giving rise to this appeal are that the deceased, Abdul Karim...” and continuing through the narration of the police report, postmortem findings, PW1’s disclosure, the alleged confessions, and the appellants’ denials.
